To do this:
System > Preferences > Keyboard Shortcuts
Scroll down to Desktop > Show the panel menu
Assign a new shortcut to that by clicking it, pressing the shortcut you want (Winkey/Super L) and clicking Close.

The idea behind Linux (one of them anyway) is to be able to configure things how you want. Forcing people to have a set use for Super would go against this.

Please no, not by defalt anyway

I use the 'super' key in combination with others as an extra ctrl key.
win + m = invert colors
win + z,x,c,v or b control music
win + scroll = zoom

If the menu were to open it would be a pain.

Having typed that, if it were set to open if only the super key was pressed then it would not be as much of a pain.

Yes by default please. Sorry, amar, you're the exception. If you set up all that other stuff, the super key won't even make it past compiz anyway.

i would also call this optional, im using the win to open a terminal (at least for something this key is useful ;) )

amar is most definitely not the exception. I tend to use super+letter combos for quick app launching. I know others who bind it as meta for emacs as well.
