Rationale
Ubuntu is a great OS, it has to be protected against other companies which claim Ubuntu uses other's intellectual propierty.

Ubuntu must be completely protected against patent infringment demands.

Solution #1: Offer Mono as a package in ubuntu-restricted repository, not by default

Firstly, I don't want to start a pro/against-Mono flamewar here. In a near future, I'm going to develop .Net on Windows, and I like some Mono applications as GnomeDo (which, in fact, I've helped translating it to Spanish).

Microsoft holds patents for the non-standards .Net libraries like Windows.Forms (and many others), Mono has implemented them, so Microsoft could demand Mono (and every Linux distribution, including Ubuntu) which offer this software.

So, I think that Mono should be treated as a multimedia codec and include Mono in ubuntu-restricted-extras, and not include this kind of software by default in Ubuntu distribution.

Solution #2: Study which software could be demanded and propose alternatives

Microsoft demanded TomTom because of a FAT patent.

Ubuntu is the main competitor of Microsoft Windows, so it could be possible that Microsoft sues Canonical (or whatever Linux-company).

This Linux-companies must be prepared against this kind of demands. Classify potential demanded software, and provide an alternative or help rewriting conflictive software modules.

Solution #3: Canonical should join to the Open Invention Network

Canonical should join the Open Invention Network to protect Ubuntu against patent claims, that is to get helped about what of its software could be demanded.

Thus, it could be more legal feedback between big open source developers, making it stronger.

Solution #1 is NOW irrelevent. Microsoft has made Mono safe from lawsuits:
